MUMBAI: The Bombay high court on Monday asked the state government what action it proposes to take against persons whose dereliction of duty forces cases of drunk driving to fall through.
A bench of Justice Abhay Oka and Justice Gautam Patel referred to a single judge bench's recent verdict, acquitting actor Salman Khan in a 2002 fatal road accident case, where he 'found fault with the investigating agency'. The judges also asked the state what guidelines and procedure it follows for collecting blood samples - in what manner the test is conducted on the site, the time within which the samples should be collected, delay in collection and analysis and also to prevent contamination. 'Is there any set protocol for immediate collection of blood samples?'asked Justice Oka.
